Dumpster Rental Agreement

  1. This Dumpster Rental Agreement (“Agreement”) is made by and between the customer and Green PNW Corp. doing business as Green PNW Dumpster Rentals (GPNW)
    Customer agrees to these terms when renting a dumpster from GPNW.

  2. Equipment Rental

    1. Customer certifies that he or she is either the property owner, has power of attorney for the property owner or is the licensed contractor/broker for the property.

    2. Customer may not sublet the dumpster for any reason.

  3. Price.

    1. The customer agrees to rent a dumpster from GPNW according to the prices and fees listed on the invoice for the type of rental being requested. The rental period begins the day the dumpster is dropped off unless otherwise granted by GPNW and will be picked up according to the rental contract unless notified that an earlier pickup is needed or a longer rental term is requested.

    2. Rate prices include one drop off and one pickup as well as the included dump fee’s. Any additional pickups needed during the scheduled rental period will be discounted plus any additional dump fee overages will need to be paid for. A rental period that needs to be extended beyond the original rental period will result in a daily rate of 35.00 per additional day.

  4. Cancellations:

    1. Should Customer want to cancel a reservation with a full refund, 48 hours’ notice must be given. A cancellation made with less than 48 hours’ notice will only be eligible for a 50% refund of the box rental. Any charges for disposal rates or dump fees paid at the time of reservation would be fully refunded in the event of a cancelation. If the customer refuses delivery of the dumpster or cancels with less than 24 hours’ notice no refund is given for the rental and only the portion of dump fees will be returned.

  5. Weight Limit.

    1. Customer agrees to restrict weight to the maximum allowed for the bin size in use. Overages on weight could result in fees for unloading of additional weight and/or overage charges. The weight limit for your specific bin is noted in every rental contract.

    2. On dumpster rentals provided with a Non-CDL vehicle, the weight limit is not to exceed 8,000 lbs or 4 tons for a safe load carrying capacity.

    3. Load capacity for our CDL Vehicles is not to exceed 10 tons or 20,000 lbs unless noted otherwise.

  6. Rental Periods

    1. All noted rental periods are in calendar days starting from the day the dumpster is delivered

    3. NOTE: RENTAL IS CHARGED AND BASED ON TIME OUT REGARDLESS IF BIN IS FULL OR EMPTY WHEN PICKED UP

    4. NOTE: CUSTOMER MUST CALL TO SCHEDULE PICKUP OF A DUMPSTER, WE DO NOT PICKUP WITHOUT NOTICE AT THE END OF THE INCLUDED RENTAL PERIOD. ADDITIONAL CHARGES WILL ACCRUE.

  7. Payment

    1. Required at time rental item is scheduled and required before delivery of the dumpster.

    2. Payment or Deposit by credit card is required on all rentals with a deposit equal to the initial invoice amount

    3. Payment with a Credit or Debit card is kept on file with Stripe and will be auto-billed for any dump fees if there is an overage beyond the included noted weight

    4. We accept Visa, Master Card, Discover, and American Express. Additionally, our invoice may have the option to use Apple Pay, Google Pay, and ACH Transfers. A debit card may be used for payment, as long as it contains a Visa or Master Card logo.

    5. GPNW has the right to place any given payment information on file with Stripe, our payment processing system for the purposes of charging any additional fines, fees or charges as a result of the dumpster rental.

    6. For customers wishing to establish credit with GPNW this will be handled on a case by case basis. Currently, all dumpster rentals are required to be paid for upfront at the time of rental

  8. Availability/Reservations

    1. Please call for item availability, reservations are welcome and advised!

  9. Pricing

    1. Prices are subject to change at any time, and without notice. Please call for price quotes.

    2. All rental charges are for time out, whether used or not.

    3. There may be additional fees if we are unable to pickup a dumpster at the requested time of pickup

  10. Responsibility

    1. Responsibility for rental items remains with the customer from delivery to pickup.

    2. Additional replacement charges are assessed on a case by case basis for missing or damaged bins.

  11. Placement of Dumpster.

    1. Customer warrants and represents that any location provided by Customer for the dumpster is sufficient to bear the weight and size of the dumpster and any vehicle required to transport the dumpster. GPNW shall not be responsible for any damage to pavement or any other road surface material, lawns, fences, shrubbery, septic system, private well, or any other form of property damage. Customer must ensure that there is a minimum of 2 foot clearance around all sides of the dumpster at time of pick up and that the front of the dumpster is not obstructed in any way. Failure to do so will result in additional fees.

      1. Furthermore, it is required that there is a minimum of 30ft in front of the dumpster to allow adequate room to pickup

      2. The customer agrees to provide unobstructed access to the dumpster on the day it is scheduled to be picked up. If the dumpster is inaccessible for any reason, or loaded improperly Customer shall be charged for any additional rental time and a minimum trip charge of 145.00

  12. Content Regulations

    1. Customer is fully responsible for the entire contents of the container and is the rightful owner of the container’s contents until the container is picked up and the contents are accepted by the prospective disposal facility.

    2. Contents that are suspect to contain asbestos must be properly tested by an approved testing firm and contain less than 1% asbestos content. More information can be found on Metro’s website here. If the customer has any questions they must be brought to GPNW’s attention before, and during the rental period.

      1. Failure to provide adequate documentation to GPNW relating to asbestos contents may result in a dumpster that cannot be accepted at disposal facilities. In the event GPNW does not receive adequate information relating to such items we reserve the right to refuse pickup of the dumpster or return it to the customers property.

      2. In the event we attempt to dump the contents and are unable to empty the bin or in the event the bin is emptied illegally due to such items being hidden within the contents of the dumpster the customer is fully responsible for any and all related costs and time associated.

        1. Any time billed will be at 145.00 per hour per occurrence for GPNW, This does not supersede any additional fees incurred to GPNW as a result of a dumpster in violation of these terms by Metro or their affiliates and sub-contractors, any additional fees that are billed to GPNW as a result of a dumpster that is dumped in this manner will be added on top of the hourly rates set out in this rental agreement.

        2. Items sticking above the top rail that can safely be re-adjusted in a timely manner without creating unreasonable spillage to the surrounding area will be charged an 85.00 handling fee

        3. Dumpsters loaded unsafe and unsatisfactory in GPNW’s sole discretion may be refused entirely and incur a 1 hour minimum charge or “Trip Fee” of 145.00 or more

    3. Hazardous and Unacceptable Material Prohibited. Customer warrants and represents that the dumpster will not contain any hazardous materials and acknowledges that the disposal of such hazardous materials is strictly prohibited. “Unacceptable material” shall mean any non-hazardous waste which is not permitted to be processed at a facility under applicable laws or permits.
      If Customer has any questions about whether a particular material is considered hazardous or unacceptable material, please call GPNW before placing and attempting to dispose of the material in the dumpster.

    4. Required for Pickup- Debris may NOT extend above the top rim of the dumpster. The tarp MUST be able to roll completely over the top WITHOUT OBSTRUCTION. The end doors MUST be CLOSED and securely latched. Failure to properly secure doors could result in property damage. GPNW is not responsible for property damage that is the result of improperly secured doors. Overfilled or unprepared containers will be brought into compliance at Customer’s expense. Every attempt shall be taken to disperse the weight within the container equally by the Customer. Failure to do so will result in a fee to the Customer. If the contents exceed the top of the dumpster GPNW reserves the right to remove such contents from the dumpster in order to make the bin safe to haul on public roads such that the contents can be secured by our tarping systems.

    5. Consequences of Violating Regulations-In the event that contents that are not allowed by this contract or any Federal, State, Parish, or City agency are disposed of, all costs, fines, penalties, or other actions taken for said disposal, the customer is fully responsible for any and all associated charges.
      Costs may include but not be limited to cleanup, monitoring, legal fees, spill cleanup, penalties, or any other charges associated with unauthorized material disposal. Materials may be returned to the customer and dumped on the customers property if GPNW determines no other reasonable means of disposal for such items at the customer’s expense.

  13. Permits, Approval, and Fees.

    1. Customer shall be responsible for obtaining all necessary permits and approvals and paying all fees that may be incurred in conjunction therewith to place the dumpster on property, public or private.

  14. Indemnification

    1. Customer agrees to indemnify and hold harmless GPNW from, against, and in respect to any and all claims, losses, expenses, damages, obligations and liabilities (including costs of collection and reasonable attorney’s fees) of any kind or nature whatsoever, including any misrepresentation, breach of contract, or non-fulfillment of any representation, warranty, covenant or agreement of or by Customer in this Agreement. This provision shall survive the termination of this Agreement.

  15. Agreement

    1. This Agreement contains the entire agreement between the Parties and supersedes all prior agreements and understanding, oral or written, between the Parties with respect to the subject matter hereof. No representation, inducement, promise, understanding, condition or warranty not set forth herein has been made or relied upon by either Party hereto.

  16. Amendment

    1. This Agreement may be modified only by an agreement in writing signed by the Parties hereto.

  17. Waiver

    1. A waiver of any claim, demand or right based on the breach of any provision of this Agreement shall not be construed as a waiver of any other claim, demand or right based on a subsequent breach of the same or any other provision.

  18. Notice

    1. Any notice required or permitted to be given under this Agreement shall be sufficient only if in writing and if sent by United States mail, certified, return receipt requested, postage prepaid, to the Parties at the addresses set forth in the rental contract and invoices. Means of delivery also include but are not limited to SMS Text message and E-mail exchange between GPNW and the customer via the contact information listed on the rental contract.

    2. IN WITNESS WHEREOF, the Parties have hereto executed this Agreement as of the date of reservation and the agreement extends until the time that all contents have been disposed of.

    3. Customer is required to notify GPNW before delivery of the dumpster If any information relating to customer address, billing address, phone number, and other contact information listed on the signed contract and invoices is incorrect.

      1. If the customer fails to properly notify and correct any information they forfeit the ability to receive any notices made by GPNW and GPNW is allowed to act in any way seen fit to remedy issues that arise.

    4. Additionally, GPNW is not responsible for any Fines, Repercussions, Environment issues or any and all other issues that arise from the disposed of contents even after the rental term has been closed.

  19. Privacy Policy

    1. Green PNW does not share or sell any of your information or credit card data.

    2. We partner with Stripe for simple and secure billing. All payment information is stored securely and is the responsibility of Stripe, Inc.
